4. Products & Services

Serge du Lau Coaching LLC offers mind-body coaching programs and related educational content. All purchases are subject to a separate Client Agreement, which governs payment terms, cancellation, refunds, and scope of service. In the event of conflict between these Terms and the Client Agreement, the Client Agreement shall prevail.

The coaching program is offered with an unconditional money-back guarantee, the full terms of which are set out in the Client Agreement. The guarantee does not imply that any specific health outcome will be achieved, and does not alter the educational and non-medical nature of the services provided.

13. Arbitration

Except for actions to protect intellectual property rights and to enforce an arbitrator's decision, all disputes, controversies, or claims arising out of or relating to these Terms or any services provided by Serge du Lau Coaching LLC shall be submitted to and finally resolved by binding arbitration under the rules of the American Arbitration Association (AAA) then in effect.

There shall be one arbitrator, chosen by mutual agreement of the parties in accordance with AAA rules. The arbitration shall take place in Miami, Florida, and may be conducted by telephone or online. The arbitrator shall apply the laws of the State of Florida to all issues in dispute. Any claim shall be arbitrated on an individual basis and shall not be consolidated with any claim of any other party. The findings of the arbitrator shall be final and binding and may be entered in any court of competent jurisdiction for enforcement.

Should either party file a court action contrary to this provision, the other party may recover attorney's fees and costs up to $1,000.

14. Force Majeure

Serge du Lau Coaching LLC shall not be liable for any delay or failure in performance arising out of causes beyond our reasonable control and without our fault or negligence, including but not limited to Acts of God, civil or military authority, fires, riots, wars, embargoes, internet disruptions, cyberattacks, or communications failures.

15. Severability

If any provision of these Terms is declared invalid or unenforceable, such provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable. The invalidity of any provision shall not affect any other provision, and the remaining Terms shall continue in full force and effect.
